Contractor Liability for Injuries to Employee – South Carolina

According to the laws of South Carolina a contractor is liable for injuries sustained by the employees of his or her subcontractors.  In such cases, the contractor would be liable to pay as if the contractor had immediately employed that worker.[i] The amount of compensation shall be calculated with reference to the earnings of the worker under the subcontractor by whom s/he is immediately employed.[ii] When the principal contractor is liable to pay compensation, s/he shall be entitled to indemnity from any person who would have been liable to pay compensation to the workers.

A principal contractor when sued by a worker of a subcontractor shall have the right to call in that subcontractor or any intermediate contractor or contractors as defendant or co defendant.[iii]
